Ann Arbor City Attorney Kent Changes Position and Refuses To Release Search Warrant Affidavit & States That District Court Was Not Failing To Meet Its Obligations Despite No Probable Cause File and Refusing To Accept Motion

  • Thomas Kent clearly states on the public court record that the search warrants were based on allegations of “embezzlement” brought by Myria’s parents with regards to the Merrill Lynch accounts despite the presence of a DPOA vitiating any such claim. The fact that the Petrou-Merrill Lynch issue was a purely civil matter was clearly outlined by the Washtenaw County prosecutor a year after the search warrants were issued (with the long time frame predicted and admonished by Judge Kuhnke) keeping the accounts frozen and our lives in limbo for over a year.
  • Thomas Kent also states that we were likely to be charged “soon” even though the prosecutor (a year later) and everyone reviewing the file said the matter was “clearly civil.”
  • Thomas Kent changed positions and did not release the search warrant affidavits in the court stating that a review was not needed. 
  • Thomas Kent also ignored the evidence that there was no overlap between the Bank of Ann Arbor checking account and the Merrill Lynch funds under investigation which attorney Mike Reynolds provided to Detective Rougeau and was part of the court record. 
  • The only “overlap” of the Bank of Ann Arbor account was with “Nick’s” subsequent false criminal allegations of extortion of Paul Cronin who surfaced weeks after this hearing and was included in a later search warrant affidavit by Detective Rougeau.
  • Paul Cronin was sitting in the court hearing with us when Thomas Kent changed positions and refused to release the search warrant affidavit. Paul Cronin also subsequently stated under oath on two separate occasions that there was no extortion and has been paid for all monies loaned in full. 
  • Thomas Kent also stated that the District Court was not failing to meet its obligations which was not true just based on Judge Kuhnke’s order which proves there was no probable cause file and as such no legal recourse to contest the search warrants.
