Brad & Myria Ask AG Nessel & Prosecutor Savit If They Know About A (Hidden) Encumbrence Paid at Bank of Ann Arbor Sheriff's Sale

Dear Prosecutor Savit and AG Nessel,

Here are the facts:

1. The Bank of Ann Arbor claims it followed lien position.
2. According to BOAA's  own ledger and the paperwork, there are unaccounted funds from the Sheriff's sale.
3. BOAA is refusing to meet with us to explain how the funds were disbursed.
4. AG Nessel's office said it was investigating the unaccounted funds from the Sheriff's sale and then said it is not investigating.
5. Prosecutor Savit's office is not communicating with us about this issue.

So why does no one want to tell us what happened to the funds?  
Why did AG Nessel's office initially say they were investigating and then they said they were not?
Does this mean there was a preliminary inquiry that somehow does not meet criteria for a full investigation?
If that is the case then there should be preliminary inquiry documentation explaining the rationale of the actions. 
There is nothing on the record.

Further, the publicly documented facts meet criteria for an investigation as the lien positions documented on the public record were not followed at Sheriff's sale. This would mean that AG Nessel was provided in her preliminary inquiry with documentation voluntarily provided from the bank justifying the payment disbursements and this information is not on the public record.
 
If the bank was not willing to voluntarily provide this documentation then AG Nessel would have to obtain search warrants (based on the Financial Privacy Act) which would mean opening an official investigation which according to AG Nessel never happened. So, first question is why is the bank not providing us with the same documentation which we clearly have a right to if they are providing it voluntarily to others?
And why is nothing documented by the AG's office?
Also the AG referred the matter in her letter to us to the county prosecutor who is not communicating with us.  Again, if the Michigan AG thinks this is a Washtenaw County issue then that would mean that whatever fraudulent debt the Bank of Ann Arbor decided to arbitrarily honor with the sheriff sale proceeds is also located in Washtenaw County.

We did also receive a letter from AG Nessel saying that a lot of the involved parties have left the state so she is limited in what she can do.
Who has left the state that is involved in this? AG Nessel cannot be referring to us as she is addressing us and she knows we are always available to talk to her. Myria's mother Maria Petrou has left the state and the country but has appointed Elias Karageorge as her legal representative who resides in Washtenaw County. Further Maria Petrou is a US Citizen and could be contacted through the US Embassy in Cyprus. Aine Kelly and Paul Cronin work at Emory but still have property in Ann Arbor. Tarick Seifeddine is the owner per the register of deeds of 1745 Brian Court. If the person that AG anyone needs to talk to is Duaa Altaee and she is out of the country then I am sure you can track her down again through the State Department. 

And anyway, the critical information here resides with the Bank of Ann Arbor which surely has not left the state of Michigan or Washtenaw County.

Re: Request for Complete BOAA Mortgage Loan Acct #500987 File


Dear Chief Compliance Officer Mr. Cherry,


We are requesting the complete file for our mortgage loan #500987 including any including any and all collateral agreements/encumbrances (including but limited to contracts, other real estate mortgages, promissory notes) lodged against/associated with the mortgage Loan Acct #500987/Sheriff’s sale funds.  As you know, we have a right to access this file and this right is protected under the Right to Financial Privacy Act of 1978 (RFPA).


As you also know, we have been asking you how the monies from the Sheriff’s sale were disbursed, the attached ledger that you sent us for the loan does not add up to account for the $1.4M Sheriff’s sale and yet you and the Bank of Ann Arbor are refusing to meet with us to explain what happened.  


The bank is claiming that lien position was followed with respect to the disbursement of the Sheriff’s sale funds and if we take you at your word given the documentation that is available to us it appears that the entire $1.4M was applied to a debt/financial encumbrance that we are unaware of (please see attached affidavits).  Given that we have been the extensive victims of identity theft as documented by numerous agencies (including the IRS), this is extremely concerning.


Why would the Bank of Ann Arbor be hiding where the monies from the Sheriff’s sale went?


We look forward to receiving our complete mortgage loan account file including any collateral agreements/encumbrances associated/lodged against the loan.
